Common Powers and Functions

Each office and executive organ in its field of activity shall have the powers and functions to:

  • Initiate polices and laws of the government consistent with the laws and policies of the Federal Government; prepare plans and budget and upon approval implement same.
  • Ensure the enforcement of policies and laws of the federal and the city governments issue directives.
  • Undertake studies and researches, collect and organize statistical data and distribute to concerned  parties.
  • Employ, administer and terminate the employment relationship with the employees in accordance with  the laws.
  • Administer its budget and properties in accordance with the financial laws and collect service fees with the laws.
  • Perform activities of capacity building and implement the Civil Service Reform Program.
  • Design strategies that enable it to work in partnership with the appropriate organs and residents and  implement same.
  • Submit periodic reports to the organ it is accountable.

The Bureau of Capacity Building

The Bureau shall have the following Powers and functions:

  • Coordinates and directs Education Bureau, Civil Service Commission, Addis Ababa Management Institute Center for Productivity Development and Kotebe Teachers Education College.
  • Taking the initiative of establishing and strengthening capacity building; ensures the implementation of them by  various executive organs, the municipal organs, and the private sector.
  • Designs strategies for executive and municipal organs to have an effective management and to render  better services.
  • Supervises and coordinates the implementation of the Civil Service Reform Programmes and provide the   necessary technical and professional support.

Education Bureau

The Bureau shall:

  • Prepare elementary level curriculum, publish books and ensure the availability of teaching aids materials in compliance with the national education policy, strategy and standard and considering of the prevailing situation of the City Government; Prepare standard for the construction of schools in the city in accordance with the national requirements and implement same up on approval.
  • Execute national examination in the city; prepare standards for examinations and certificates given by  elementary and high schools found in the city; ensure implementation of same upon approval.
  • Administer technical and vocational training junior colleges unless otherwise provided by this  proclamation or other laws; facilitate the provisions of vocational and skill upgrading trainings consistent  with the economic activities of the city for school drop-outs, high school graduates that are unable to join   higher educational institutions and unemployed persons, design strategies of capacity building for the  existing centers that are engaged in non-formal basic and vocational training activities.
  • Cause the provision of educational programmes to be supported by mass media, devise mechanisms to  extend distance and continuing education programs and supervise the implementation thereof.
  • Cause to accord affirmative measures as regards to educational services given for women, children, adults and for persons with special needs.
  • Train or cause to train teachers and other educational personnel in accordance with the national standard of training and give institutional as well as engage in the sector.
  • Supervise educational institutions run by the government with a view to ensue their compliance with the  set standard and accredit same; provide information service and other supports for investors  want to engage in the sector; ensured that high schools established by local investors are in compliance  with the standards set forth.

Civil Service Commission

The commission shall have the following powers and functions:

  • In accordance with the general established requirements for education, training and experience at the national level, determines the class of positions and grades to which all positions, in government offices, shall be assigned as well as the required qualification for each class of positions.
  • Ensures that salary, payment of various allowances, benefits and other working conditions in relation to  civil servants of the city Government are implemented. Gives decisions on cases arising in relation to these matters.
  • In accordance with the civil service law of the city government, issues standards of performance appraisal  of the city civil servants and other directives; supervises the implementation of same;
  • Supervises the execution of recruitment, placement, promotion, salary scale, transfer, training and  compliance to disciplinary rules of the civil servants in the city government is in accordance with the law; undertakes studies in search of solutions for the difficulties raised with regard to interpretation and  application of the laws and causes the implementation of same.
  • Gives final decisions upon request submitted for employement termination of civil servants of the city government on  grounds of inefficiency and on extension of service of the civil servants of the city government beyond the  retirement age in accordance with the law.

Urban Management Institute

  • The institute shall have the powers and functions as well as organizational structure and operation as defined in the Addis Ababa Management institute Establishment Regulations.

Productivity Improvement Center

The center shall have the following power and functions:

  • In accordance with the need of educational and training policy of the country, develops curriculum for  training, counseling, study and research services, prepares curriculum and program for activity and  implements same upon approval;
  • Gives trainings to employees of Governmental and non-governmental organizations as well as private applicants from various parts of the county.

  • The college shall have the powers and duties as organizational structure and functions given to Kotebe Teachers training college of Addis Ababa by regulation No 12/1991 and shall be accountable to the Bureau of Capacity Building.

Bureau of Trade and Industry Development

The Bureau shall have the following powers and function to:

  • Trade and industry Development bureau has two deputy bureaus that are trade and industry sector and micro and small scale business enterprise development sector. It also co-ordinate and direct tourism commission and Investment Authority;
  • Cause the expansion of trade, industry and handicraft in the city; encourage wider participation of local investors in trade and industrial activity of the city and render technical as well as counseling services;
  • Initiate applicable industrial projects that are in accordance with the investment policy and law, cause them to be studied and implement same;
  • Publicize the city products inside the city, participate in exhibition organized by regional states; issue license of trade fair organized in the region;
  • Encourage and support establishments of chamber of commerce in the city; organize and administer the commercial registry of the city; issue license for business organizations after they have been registered in accordance with the law;
  • Register, Issue license and supervise local investors engaged in trade and that established medium size industries in the city;
  • Issue standard for market centers, in accordance with the standard; design the strategies for the expansion and development of same;
  • Causes the promotion of micro and small scale business enterprises in the city;
  • Facilitates conditions for supporting the micro and small scale business enterprises by establishing relationships with governmental and non-governmental organizations in the city, such arrangement shall specially be made to obtain production and sales center, financial and loan services, raw materials and machineries as well as infrastructures;
  • Facilitates the conditions for the establishment of micro and small scale business training center; cause the preparation of training programs and exhibition for the community members that are engaged in micro and small scale business activities and coordinates same;
  • Conducts studies on micro and small scale business projects that could enable unemployed youth and women to be productive, supervises the implementation and effectives of same;
  • Establishes the system to render information and counseling services for customers;
  • Organize, register and promote co-operatives; issue registration certificate conferring legal personality; cancel from the register of cooperatives upon dissolution;
  • Study and propose ways by which co-operatives can establish co-operative banks by combining and strengthening their financial capabilities; and it shall implement same upon approval;
  • Provide the necessary support to co-operatives so that their managements and accountings follow modem system, and it shall assist member to develop saving culture and sense of ownership on their co-operatives; it shall also, to this end prepare and provide the necessary educational and training programmes;
  • Provide training to member, employees and professional of co-operatives by preparing successive educational and training programmes that enable to promote and develop and the concept of co-operatives; it shall in collaboration with concerned organs, devise means by domestic as well as external training and educational opportunities are obtained'
  • Make relations with appropriate regional and federal government organs in order to exchange experiences that would help to achieve its tasks and to support each other;
  • Conduct study and research activities that would help to promote and strengthen co-operatives and shall distribute necessary information by making market studies. it shall also collect, organize and pass statistical data on to the concerned body. It shall as well, as without prejudice to the provisions of the proclamation, study incentives that might be given to co-operatives, and shall ensure their implementation up on approval;
  • Prepare and implement model articles of association of co-operatives;
  • Design strategies for the production and supply of quality agricultural products and for the expansion of investment that enhances agricultural development ing the city and implement same upon approval;
  • Facilitate the ways for the distribution of improved products of agricultural technology. Selected seed and fertilizer supervise the out come thereof; give education and training as well as render professional support to farmers;
  • Ensure that veterinary and cross-breeding services are given to domestic animals of farmers; expand and administer animal breeding and reproductive enters in the city; administer laboratories of genetic resources; and cause farmers to use research findings,
  • Ensure that animal skin and hides are produced in quality according the national standard;
  • Ensure that the veterinary drugs and chemical pesticides in the market are in accordance with the rules and regulation, standard and the date for the use of drug is not expired;
  • Running the poultry production center for the better use of beneficiates, especially for small, medium and high level poultry farm enterprise.

Tourism Commission

The commission shall have the following powers and functions:

  • Registers tourist sites in collaboration with the stake holders: facilitates the ways for organization promotion and preservation same; give support to the expansion to tourist activities;
  • Submits the findings of studies undertaken for the expansion of tourist activities in the city and for the preparation of comfortable hotels and recreation centers for both local and incoming tourists; ensures that hotels and recreational centers for both local and incoming tourists; ensures that hotels and recreational centers are in accordance with the standards set forth;
  • Causes the distribution, locally and abroad, of postcards, brochures and various publications locally and abroad, of postcards, brochures and various publications on which cultural heritages and antiques are printed;
  • Issues license and supervise individuals and enterprises that are engaged in tourism;
  • Administrate Addis Ababa museum.

Investment Authority

The Authority shall have the following powers and functions to:
1. Coordinates, promotes and encourages the investment activities of the city; renders the      necessary advice and technical supports.
2. Publicizes the favorable investment opportunity of the city to investors in conducting detail studies.

3. Issues the investment licenses upon requests for investment permits that fall under its  jurisdiction are presented, verifyies that the required documents are produced in accordance with the laws, transfer the matter to the appropriate organ for the issuance of trade and industrial license; give proper response the requests of tax exemption by investors while importing goods from abroad in accordance with the investment law.
4. Facilitate ways for the provision of production and sales centers, financial and loan services, the      opportunity to get raw materials and machineries with low prices and the fulfillment of various      infrastructures for investment enterprises.

Environment Development Office

The Office shall have the following powers and functions:

  • Develops suitable residential and working areas in prioritizing areas affected by serious problems and  alleviate same progressively through the direct participation of the community in constructing vital and  demanded infrastructures and market areas.
  • Facilitates the ways for income generating opportunities for those residents that are living with low or no  income.
  • Causes creation of sense of ownership among the residents by encouraging direct participation of  them from initiation to implementation of projects; cause the residents to take over finalized projects and administer and maintain them when damaged.
  • Coordinates harmonization and mutuality of environment development   activities among various  sub-cities.
  • Designs the strategies to get resources that serve for environmental development activities and implements same upon approval.
  • Engages in and causes construction of flood confine for vulnerable areas to overflooding in collaboration with the residents and other concerned organs.

Finance and Economic Development Bureau

The Bureau shall:

  • Coordinate and direct activities of Revenue Agency, Environmental Protection Authority, Policy Studies and Plan Commission.
  • Prepare and submit to the mayor a consolidated annual budget along with a supplementary budget as  may be necessary, upon analyzing recurrent budget proposals received from the City Government organs  and the budgetary allocation of sub-cities and administer same in accordance with the law.
  • Prepare and submit budgetary allocation formula of sub-cities based on the decentralization principle of budget administration, implement same upon approval; inspect the expenditure of budget subsidy allocated to sub-cities;
  • Custody the income collected by Revenues Agency from donation and loan; safe guard and administer the city Government’s finance, local and external loans and various funds;
  • Submit recommendations of new revision on taxation and tariffs, implement same upon approval;
  • Borrow money on behalf of the City Government from internal sources in accordance with the  appropriate law;
  • Establish general accounting systems of the City Government, publish and distribute financial receipts,  formats and registers to the central organs of the Government and sub-cities; submit consolidate  financial report;
  • Facilitate, in accordance with the law, mechanism for establishment of good relationship between the city Government and local as well as foreign sister cities; search for technical support from donor countries and organizations;
  • Receive and accommodate parties seeking cooperation with the city and facilitate their contact with the  concerned organs of the Government.

The Agency shall:

Policy Studies and Plan Commission

The commission shall have the following powers and functions:

  • Prepares long and medium term physical and socioeconomic plans and program, of the city; coordinates plans of sub-cities; inspects the local development plans prepared by sub-cities with a view of their acceptability and gives decisions thereof; in so doing, builds up the capacity of the sub-cities.
  • Prepares and submits recommendations on general socioeconomic plans and revises as well as updates  structural plans, prepares the development strategies of the city that motivate participation of the private  sector; implement same upon approval.
  • Prepares and submits the economic account of the city, investment and government expenditure  programs.
  • Ensures that the capital projects are in conformity with the general plan; causes monitoring and evaluation of  the implementation of plans.
  • Causes the implementation of National Population Policy in compliance with the existing realities of the city.
  • Undertake research and studies on policy matters and submit policy proposals for decision.
  • Gather, analyzes and distributes population and geographical development information; prepares general land  maps; design strategies for the public to benefit thereof.

Bureau of Social and Civil Affairs

The Bureau shall have the following power and functions:

  • Coordinate and directs Office of Social Affairs and Non-governmental organizations, Labor Affairs Office, Youth and Sports Commission and Women’s Affairs Office.
  • Promotes establishment of professional associations and other civil associations and strengthens thereof;
  • Arranges and implements training programs that can help professional associations and other civil associations to work in partnership and share experiences among themselves.
  • Creates conducive environment for professional associations and civil associations to participate in  development and building democracy; causes them to discuss on policies and work program of the City  Government and basic national issues ; counsel the associations and gather their opinion before passing decisions that could affect the associations and their members; facilitates conditions for partnership among  all organs of the city Government at all tiers and professions and civil associations.

Social Affairs and Non-governmental Organizations Office.

The office shall:

  • Develop appropriate strategies and implement same upon approval for Children and Youth under difficult  circumstances, the elderlies and persons with disabilities.
  • Create conducive ground for the establishment of institutions that render various services by the city   government and Non-governmental organizations for children and youth under difficult circumstances, the elderlies and persons with disabilities that can not otherwise be catered by community-based rehabilitation;  administer orphanages, institutions that serve the youth, the elderlies and persons with disabilities, or devise strategies for the administration of the institutions by non-governmental organizations or jointly with them and implement same upon approval.
  • Develop strategies for the participation of the community to eliminate social problems and social evils.
  • Request for, receive and distribute assistance to the people being helped; declare the degree of  emergency disaster whenever it occurs in the city; reserve materials and foods that can be used during emergency disasters.
  • Study and propose mechanisms that strengthen efficient and coordinated operation in partnership on  matters if social security between governmental and non-governmental organizations; ensure the  implementation of same upon approval; forward its opinion to the concerned governmental organs, as may   be necessary for the projects undertaken by non-governmental organizations, on issuance of work and      residence permit to foreign nationals as well as in request on tax exemptions on imported items;
  • Effect agreements and follow up the implementation of projects propose by no-n-governmental organizations in ascertaining their appropriateness.
  • Support social security activities undertaken by non-governmental organizations.

Labor Affairs Office

The Office shall:

  • Provide educational and training services for employers and employees that are found in the city to  promote industrial peace; develop methods for the expansion of labor counseling services, register vacancies and labor exchange and implement same upon approval.
  • Register and support employers associations and trade unions in accordance with the directives issued by relevant organs of the federal government.
  • Attempt to amicably resolve disputes that could arise during negotiations of collective agreement; register collective agreements in ensuring that they are concluded in accordance with the labor proclamation.
  • Attempt to reconcile parties involved in collective labor dispute.
  • Undertake studies, researches and gather information in collaboration with appropriate organs on job  classification, employed and unemployed human resource of the city;
  • Supervise labor standards issued for the protection of the safety and health of workers, ensure safety of working environment and if protective devices are applied by the undertakings.
  • Issue licenses of competences, support and supervise labor exchange agencies operating in the city.

Youths and Sports Commission

The commission shall:

  • Facilitate conditions that enable the youths of the city to actively participate in the process of development and  building of democracy as well as ethically shaped personality and for the enhancement  services that assist the youth to obtain better knowledge.
  • Improve and enhance cultural sports; properly manage and administer sports centers; encourage  production of sport equipments and materials in the city in collaboration with appropriate organs and  investors; facilitate to obtain same through donation and procurement.
  • Train sportspersons, trainers, arbiter and the like by developing scientific physical training methods;
  • Organize and direct the city’s sports tournaments; particularly, promote and strengthen sports  tournaments in the schools of the city in collaboration with Education Bureau.
  • Register sport associations and clubs; provide certificate of registration in accordance with the law and  national policy; inspect books of accounts of sport associations in order to ensure that their income is  used only for the desired goal.
  • Arbitrate disputes that arise among and between Federations and associations in the city.

Women's Affairs Office

The office shall:

  • Follow-up whether the rights of women are respected in the implementation of policies and laws in the city government as well as the overall rights of women are protected during the issuance of new law.
  • Conduct investigation upon receiving compliant of violation of the rights of women and ensure that  measures are taken by the appropriate organ.
  • Provide continuous education through various mechanisms on gender and equal rights of women.
  • Organize and provide educational, professional and additional skills training; prepare projects that benefit women and facilitate their implementation.
  • Facilitate the establishment of women organizations and their access to credit and saving services in collaborate organs.
  • Provide the necessary support for the establishment and strengthening of associations advocating for the  rifts and welfare women.

Bureau of Justice and Legal Affairs

The Bureau shall have the following power and functions to:

Coordinate and direct the prosecution office, the city courts and social courts.

Be chief advisor to the city Government on legal matters: provide legal advices to bureaux and other executive organs upon request.

Institute, cause to institute or intervene in suits fore courts and any adjudicating organ or arbitration commission whenever it deems necessary to protect the rights of the city government and the interests of residents.

Represent in litigations bureaux other executive organs designated by the mayor and the mayor and the organs under the city manager; terminate non-viable litigations; follow up the handling of civil suits and clams of other organization of the City Government as may be necessary and request reports and insure that qualified personnel are in place for the same.

Prepare, upon request, agreements and contracts in which the Mayor or bureau heads are involved with other parties.

Initiate new laws, amendments of laws based on research and studies, conduct studies for the enactment of new laws upon the request of bureaux, professionals and civil associations; it shall draft laws.

Conduct legal researches and studies; provide legal education to raise the legal consciousness of the residents; cooperate with the appropriate organs on legal education and training; organize and compile the laws of the City Government for research and studies for the Bureau's consumption.

Prosecution Office

The prosecution Office shall have the following powers and functions:

Institutes and prosecutes criminal cases against persons alleged to have committed crime with a purpose protecting the general interest of the City Government and residents in accordance with the charter; withdraws criminal charges and dismisses criminal cases; orders the commencement and the discontinuance of criminal investigation as may be necessary; performs other duties in accordance with the law.

Ensures that crime investigation organs carry out their duties in accordance with law.

Examine, petitions and takes appropriate measures that are within the power and responsibilities given by law to the office.

Jurisdiction of the Addis Ababa City Courts

The Addis Ababa City Courts shall have jurisdiction over the following matters:

  1.   Civil Jurisdiction

• Suits on possessory right, issuance of permit or land use as relating to the enforcement of the City Master plan:

•  Suits brought in connection with the regulatory powers and functions of executive bodies of the City Government;

• Suits on fiscal matters set out under Article 52 of this charter;

•  Suits brought in connection with administrative contracts concluded by executive bodies of the City Government or by enterprises under the ownership thereof;

• Disputes arising between executive bodies of the City government or between other organs thereof;

•  Suits brought in connection with government owned houses administered by the City Government;

• Applications for change of name;

• Application for certificates of succession, marriage and guardianship

•  Applications for the declaration of absence and death.

2. Criminal and Petty Offence Jurisdiction

• Charges brought in connection with fiscal matters set out under Article 52 of this charter:

•  Cases of petty offence;

• Without prejudice to the jurisdiction of federal courts on the substance of federal offenses, Cases brought in accordance with Article 33, 35,53, and 59 of the code of criminal procedure of 1961.

•  Without prejudice to the other provisions of this Article, cases of execution of penalties, for petty offences, imposed by executive bodies of the City Government.

The Jurisdiction of the Social Court

In accordance with the stipulation of the Revised Charter and this proclamation, the Social Court shall have jurisdiction over the following civil cases and petty offences.

  1. Without prejudice to the jurisdiction of judicial power vested in other bodies in the charter proclamation, the Social Court shall have jurisdiction over cases involving property and pecuniary disputes an amount not exceeding Birr five thousand (5,000).
  2. Shall have the power to adjudicate offences committed inviolation of the regulations applicable within the City.
  3. Without prejudice to the stipulation under sub article 2 of this article, the social court shall have the power to adjudicate criminal offences annexed with the proclamation taken from the Federal Penal code.

Bureau of Information and Culture

The Bureau shall:

  • Serve as a spokeperson to the City Government; publicize in using various methods government polices, strategies and laws to the residents of the city; disseminate information; facilitate mechanisms of  information exchange among government organs.
  • Publicize socioeconomic activities of the city and issues concerning the  residents of the city and the various social group within and out of the city; prepare and issue announcements.
  • Issue professional licenses and supervise newspapers, magazines and other press products that are  printed and distributed within the city.
  • Coordinate and direct, in accordance with the law, the City Government’s mass media.
  • Study, protect and cause others to protect, in accordance with the law, historical relics that are found in the city; organize and administer cultural museums, conduct study of languages and enhance literature for the  registration of history and culture of the country and residents of the city.
  • Ensure the enhancement and expansion of culture, arts, fine arts and creativity in the city; work towards eliminating harmful traditional practices; register, issue licences, follow up and supervise art associations and clubs that operate in the city; support governmental and non-governmental organizations engaged in  cultural activities.
  • Promote the establishment and expansion of libraries, archives and museums.

Mass Media Agency

The Agency shall have the following powers and functions:

  • Disseminates news and information that are useful to the residents of the city through publications, radio and television; owns regular publications, radio and television programs.
  • Studies the provision and expansion of effective and efficient publications, radio and television services that are supported by appropriate technology and ensures the implementation of same upon approval.
  • Produces special programs that enhance the awareness of the residents concerning legal and democratic  rights; disseminates different literatures, radio and television programs to enhance the general knowledge and to satisfy recreational needs of residents in using different media.
  • Receives and transmits free public opinions and suggestions; investigates and declares results to the public.
  • Publicizes current political, economic and social matters.
  • Provides services of picture documentation, advertiesements and printing press.
  • Establishes work relations with local and overseas similar organizations to exchange new practices, and information as well as trainings and share experiences.
  • Organize and administer in the proper site the editing and transmission as well as linking and other   institutions and equipments that are required in the provision of publication services, radio and television programs.

Bureau of Health

The Bureau shall:

  • Establish health service standards and ensure its implementation in accordance with the National Health  Policy and Standards; provide or cause to be provided health awareness raising education to the  residents of the city;
  • Control, conduct surveillance, supervise, prevent and collect information concerning communicable  diseases upon conducting survey and investigation; prevent epidemic diseases in collaboration with  appropriate organs;
  • Provide or cause the provisions and supervise same services; provide reproductive health services;
  • Administer, in accordance with the law, hospitals and health care training institutions owned by the City  Government.
  • Distribute medicines and medical equipments that are provided by the Federal Government and donor organizations for the implementation of different programs.
  • Develop strategies for the application and treatment of traditional medicines side by side to modern  medicines.
  • Control storage and use of medicines in hospitals.
  • Issues renew and supervise certificates of competence for medical institutions established by  private investor.
  • Conclude agreements and contracts with and sign agreements with non-governmental charity organizations that conduct programmes of medical services, and follow up the implementation of same;  issue, renew and supervise professional license to the clinics established by same.
  • Organize data on the activities undertaken to control HIV/AIDS and other diseases, in the city submit the results after analyzing same.
  • Organize and provide health care counseling and information services.

HIV/ AIDS Prevention and Control Office

The office shall:

  • Implement in the city the national policy to prevent and control HIV/AIDS in collaboration with  governmental and non-governmental organization as well as involving the residents of the city;
  • Encourage researches on HIV/AIDS in the city and facilitate the utilization of the findings of the  researches in accordance with the policy;
  • Work in collaboration with governmental and nongovernmental organizations that are involved in activities  to prevent and control HIV/AIDS, assist victims of HIV/AIDS and those who lost their family by  HIV/AIDS.
  • Collect and distribute assistance in collaboration with governmental and non- governmental and donor  organizations.
